warranty gift redemption terms & conditions
1. Promoter
The promoter is DIY Resolutions Pty Ltd (ABN 72 103 688 679) of 7a Callister Place, Craigieburn, Victoria, 3064, Australia and DIY NZ Pty Ltd (NZBN 9 429 048 839 501) of 4 Matukutūruru Road, Wiri, Auckland, 2104, New Zealand ("we", "us", "our", "the Promoter"). 2. Promotion Overview
We are offering a complimentary oval spoon rest (the "Gift") to Eligible Customers (defined in clause 4) who:
(a) purchase a Qualifying Product (defined in clause 5) during the Promotion Period (defined in clause 3);
(b) register that purchase with the Promoter for warranty purposes; and
(c) opt in to receive the Gift,
in accordance with these terms and conditions ("Terms").
3. Promotion Period
The promotion commences 10 August 2026 and ends on 10 August 2027 unless stock runs out.
4. Eligibility
The promotion is open to individuals who:
(a) are residents of Australia or New Zealand;
(b) are aged 18 years or over;
(c) have purchased a Qualifying Product from Bunnings Warehouse listed on https://kaboodle.com.au/find-a-bunnings in Australia and https://kaboodle.co.nz/find-a-bunnings in New Zealand; and
(d) provide a valid delivery address within Australia or New Zealand,
(“Eligible Customers”).
5. Qualifying Purchases
A "Qualifying Product" is any product sold by the Promoter or its authorised resellers with a retail price of AUD$2,000 or more (for purchases in Australia) or NZD$2000 or more (for purchases in New Zealand, purchased before or during the Promotion Period.
The customer must retain proof of purchase (such as a tax invoice or receipt) and may be required to provide it together with proof of eligibility under clause 4 for verification by the Promoter before the Gift is dispatched.
6. How to Claim
To claim the Gift, Eligible Customers must:
(a) complete the online product registration at https://kaboodle.com.au/enjoy/register-for-warranty (AU) if purchased in Australia or https://kaboodle.co.nz/enjoy/register-for-warranty-nz (NZ) if purchased in New Zealand;
(b) provide accurate personal and purchase details, including a valid delivery address within Australia or New Zealand; and
(c) tick the box on the registration form indicating they wish to receive the free oval spoon rest,
(“Eligible Claim”).
Registration is voluntary, and ticking the spoon rest box is voluntary. A customer may register their purchase for warranty purposes without claiming the Gift.
7. The Gift
Each Eligible Claim is entitled to one (1) oval spoon rest. The approximate retail value of the Gift is $30 AUD (for purchases in Australia) and $35 NZD (for purchases in New Zealand). The Gift is supplied by Le Creuset Australia Pty Limited (ABN 87 142 378 327) of Suite 4, Level 4, 601 Pacific Highway, St. Leonards, NSW, 2065, Australia for purchases in Australia and Le Creuset New Zealand Limited (NZBN 9 429 030 111 684) of PO Box 72792, Papakura, Auckland, 2244 for purchases in New Zealand[AW1] [ST2] and is not manufactured by the Promoter. Colours, designs and exact specifications may vary from any images shown in promotional material.
The Gift is not transferable and cannot be exchanged or redeemed for cash or for other goods.
8. Limit
A maximum of one (1) Gift is available per Eligible Claim. An Eligible Customer who makes multiple Eligible Claims during the Promotion Period may receive one (1) Gift for each Eligible Claim, subject to availability (in accordance with clause 9).
9. Availability and Substitution
Gifts are available during the Promotion Period only while stocks last. The total number of gifts available is 450 x in Australia and 120 x in New Zealand. If demand for the Gift exceeds available stock, the Promoter reserves the right (subject to applicable laws and to clause 15) to:
(a) close the promotion before the end of the Promotion period and notify customers accordingly;
(b) substitute the Gift with an item of comparable nature and equal or greater value; provided that, if the substitute Gift is not acceptable to an Eligible Customer, the Promoter will notify the Eligible Customer and they may withdraw their claim[SK3] ; or
(c) supply the Gift at a later date once additional stock becomes available provided that any delay does not exceed 6 weeks from the date of the Eligible Claim.
10. Delivery
The Promoter (or its nominated agent) will deliver the Gift to the address provided at registration within approximately 4-6 weeks of an Eligible Claim, at no cost to the recipient. Delivery is only available within Australia and New Zealand.
The Promoter is not responsible for delays or non-delivery caused by incorrect or incomplete address information provided by the customer, courier delays, or events outside the Promoter's reasonable control.
11. Warranty Registration and Statutory Consumer Rights
Registering a Qualifying Product enables the Promoter to administer warranty claims more easily. However:
(a) The Gift is offered as a thank-you for registering. Registration is not required for any voluntary warranty offered by the Promoter to apply.
(b) Your rights under consumer protection laws apply regardless of registration. In Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). In New Zealand, consumer guarantees apply under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. These guarantees cannot be excluded or limited in respect of goods ordinarily acquired for personal, domestic or household use or consumption. The oval spoon rest and Le Creuset products are such goods. Your statutory rights under those Acts are additional to, and not affected by, any voluntary manufacturer's warranty. These rights apply whether or not you register your purchase, whether or not you claim the Gift, and whether or not you accept these Terms.
(c) Nothing in these Terms excludes, restricts or modifies those statutory rights.
12. Third-Party Gift
The Gift is sourced from a third-party supplier. The Promoter has selected the Gift in good faith but does not manufacture it. Any concerns about the Gift should be raised with the Promoter in the first instance using the contact details in clause 1, and the Promoter will work with the Eligible Customer and the supplier to resolve the matter consistently with the customer's statutory rights.
13. Privacy
Personal information collected through the registration process will be handled in accordance with the Promoter's Privacy Policy (available at Kaboodle Privacy Policy), the Privacy Act 1988 (Cth) and the Australian Privacy Principles for Australian customers, and the New Zealand Privacy Act 2020 and the 13 Information Privacy Principles contained therein for New Zealand customers.
Information collected will be used to:
(a) administer the warranty registration for the Qualifying Product;
(b) administer this promotion and verify eligibility;
c) arrange delivery of the Gift; and
(d) communicate with the Eligible Customer about their purchase, registration and the Gift.
Information will not be used for marketing purposes unless the Eligible Customer has separately consented to receive marketing communications by ticking a separate consent box. Any electronic communications sent to New Zealand customers will comply with the Unsolicited Electronic Messages Act 2007 (NZ). Each such communication will identify the Promoter as the sender and will include a functional unsubscribe mechanism allowing you to withdraw consent to receive future marketing communications at any time. Personal information may be disclosed to the Gift supplier, to delivery providers, and to other service providers strictly for the purposes set out above.
Customers may request access to or correction of their personal information, or make a privacy complaint, by contacting info@kaboodle.co.nz or 0800 522 663 (for New Zealand customers) or info@kaboodle.com.au or 1800 666 078 (for Australian customers). New Zealand customers may also contact the Office of the Privacy Commissioner.
14. Verification and Disqualification
The Promoter may verify the validity of any registration or Gift claim, including by requesting proof of purchase. The Promoter may, acting reasonably, refuse to provide a Gift to any person who:
(a) provides false, incomplete or misleading information;
(b) submits multiple registrations for the same Qualifying Product;
(c) is not eligible under clause 4; or
(d) engages in conduct that is fraudulent, unlawful or inconsistent with the spirit of the promotion.
15. Liability
To the maximum extent permitted by law, the Promoter and its officers, employees, agents and contractors are not liable for any loss, damage, cost or expense (including indirect or consequential loss) suffered or incurred in connection with this promotion or the Gift.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993, the New Zealand Fair Trading Act 1986 or any other applicable law.
In Australia, where the Promoter is liable for a failure to comply with a consumer guarantee in respect of goods that are not of a kind ordinarily acquired for personal, domestic or household use or consumption, the Promoter's liability is limited (at the Promoter's election) to replacement, repair or refund.
Where the Promoter is liable for a failure to comply with a consumer guarantee in respect of goods supplied to a New Zealand customer that are not of a kind ordinarily acquired for personal, domestic or household use or consumption, the Promoter's liability to that New Zealand customer may be limited (at the Promoter's election) to replacement of the goods or the supply of equivalent goods, repair of the goods, or payment of the cost of replacing or repairing the goods, in accordance with section 43 of the Consumer Guarantees Act 1993.
For the avoidance of doubt, the limitation in the preceding paragraph does not apply to New Zealand consumers in respect of the Qualifying Products or the Gift, which are goods ordinarily acquired for personal, domestic or household use. New Zealand consumers' rights under the Consumer[SK4] Guarantees Act 1993 and the Fair Trading Act 1986 in respect of those goods cannot be limited or excluded.
16. Amendments
The Promoter may amend these Terms where reasonably necessary, including to comply with applicable laws, to address operational or technical issues, or to correct errors. Amendments will not materially disadvantage Eligible Customers who have already submitted a valid registration before the amendment takes effect. 17. Governing Law and Jurisdiction
17.1 Australian customers: For purchases made in Australia, these Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them.
17.2 New Zealand customers: For purchases made in New Zealand, these Terms are governed by the laws of New Zealand. The parties submit to the non-exclusive jurisdiction of the courts of New Zealand. Nothing in this clause 17.2 prevents a New Zealand customer from exercising any right to bring proceedings in any court of competent jurisdiction.
17.3 Nothing in this clause 17 limits any mandatory right a customer has under the law of their country of residence, including under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or the Privacy Act 2020 (New Zealand[SK5] ).
18. Acceptance
By submitting a registration and ticking the box to claim the Gift, the customer confirms they have read, understood and accepted these Terms.
